The second began inside a shared workshop building, where a fine paint mist allegedly crossed the boundary between neighboring units and settled on a collector’s vehicles. It was whether the evidence showed that the other party was legally responsible for it.

Case One: The Dogs That Reached the Street

The first case concerned a neighborhood dispute involving Lora Saczawa, referred to in court as Miss Saczawa, her daughter, Cody McMaster, and several dogs. Miss Saczawa said she and her daughter were preparing to walk two of their dogs: a Chihuahua and a German Shepherd. The family had three dogs in the backyard, but only two were being taken out.

The plan changed when the German Shepherd ran off before it had been secured on a leash. The dog entered the fenced yard associated with Cody McMaster’s property. At the same time, the Chihuahua ran across the street. Miss Saczawa called for Chris and her daughter to help retrieve the dogs. Her daughter went to get a leash, while Miss Saczawa crossed the street and picked up the Chihuahua.

The testimony placed the parties in close proximity. Lora Saczawa’s home and Cody’s home were separated by a small house occupied by a tenant. The neighboring layout became important because the court had to determine where each dog was, where the people were standing, and where the confrontation ultimately occurred.

While Miss Saczawa’s daughter was trying to return with the dogs, someone came to Cody’s door. The door opened, and Cody’s two pit bulls came out. The testimony established that only one of the pit bulls became involved in the fight.

How the Fight Escalated

A neighbor, identified in the transcript as Miss Rivera, watched the events from near her driveway. She said she had been outside cleaning out her trunk when the Chihuahua ran into her yard. She saw Lora Saczawa retrieve the Chihuahua and begin walking back. The German Shepherd followed behind.

According to Miss Rivera, the German Shepherd stopped near the front of Cody’s house, around the driveway and front yard. The dog was sniffing around near trees before the encounter developed further. A person knocked on Cody’s door, the door opened, and the pit bull came outside.

At first, the dogs growled and barked. Miss Rivera said they appeared to be antagonizing one another. The confrontation then moved toward the front of Cody’s property and into Arthur Street. The dogs ultimately launched at each other in the street rather than remaining in the front lawn.

The fight was difficult to stop. Cody’s roommate was able to move one dog away briefly, but the dogs continued to growl and engage. Other people on the block became involved. Water was thrown on the dogs in an effort to separate them. Miss Rivera estimated that Cody McMaster arrived approximately five to seven minutes after the events began, after his roommate had come outside.

Lora Saczawa’s daughter, Chrissa, entered the middle of the fight in an attempt to separate the dogs. She later had blood on her, and those present initially believed she might have suffered puncture wounds. The testimony clarified that the blood came from the dogs as they held onto each other. The transcript does not establish that Chrissa was punctured.

The two dogs were eventually separated. Miss Saczawa claimed that her dog had been attacked and sought payment for veterinary expenses described in court as more than $300. She also maintained that her dog had been on a leash during the relevant part of the incident.

The Witness Who Changed the Balance

Miss Rivera’s testimony became the most important account of the confrontation. Judge Judy repeatedly tested the witness’s observations against the map of the neighborhood. Miss Rivera confirmed that the dogs had moved from the property area into the street. She also confirmed that Miss Saczawa’s German Shepherd had been loose and had been on Cody’s property before the fight moved away from it.

That distinction mattered. A witness who wanted to strengthen Miss Saczawa’s position might have placed the entire fight on Cody’s front lawn. Instead, Miss Rivera described the encounter as moving into Arthur Street and then farther toward Miss Saczawa’s home. Judge Judy treated that detail as evidence that the witness was not simply repeating a favorable version of events.

The court also focused on control of the animals. Miss Saczawa’s dog had initially escaped before it was leashed. Cody’s dog had come out of the house while the German Shepherd was loose near the property. Judge Judy concluded that both sides had dogs outside their owners’ control at a critical point.

Lora Saczawa tried to explain that her dog had been leashed when the attack occurred and that she had photographs showing injuries. Judge Judy did not necessarily reject the possibility that the dog had been injured. Instead, the judge found that the evidence did not establish that Cody McMaster should be required to pay for those injuries.

Why Judge Judy Dismissed the Claim

Judge Judy’s reasoning was direct. If Lora Saczawa’s dog had been properly leashed and Cody’s dog had been the only animal out of control, responsibility for the veterinary bills might have been different. But the testimony showed that the German Shepherd had escaped and had entered Cody’s property before the encounter moved into the street.

Judge Judy also noted that Cody had two pit bulls, but only one was involved in the fight. She considered the fact that Lora Saczawa’s larger dog was loose and had trespassed onto the property, while Cody’s dog was also outside. In the court’s view, the evidence did not support shifting the veterinary costs entirely to Cody.

The case was dismissed. Each side was left to pay its own expenses, including the veterinary bills. The ruling rested on control, sequence, location, and credibility rather than on the existence of an injury alone.

Case Two: The Overspray on the Collector’s Vehicles

The second case, identified in the transcript as Larkin v. Nelson, involved vehicle damage allegedly caused by lacquer overspray. Mr. Larkin maintained a storage unit of approximately 1,000 square feet in which he kept collector vehicles. He testified that he owned three 1970 El Caminos and two Harley-Davidson motorcycles.

Mr. Larkin said he discovered the damage when he removed the vehicles from storage in April 2016. He had visited the building during the winter, but he had not taken the vehicles out, washed them, and examined their surfaces closely. As a result, he could not identify the exact date on which the alleged damage occurred. He placed it sometime during the winter.

The unit was next to one used by James Nelson. Mr. Larkin claimed that Mr. Nelson had sprayed materials in his unit and that a fine mist had crossed the dividing wall. The substance allegedly settled on the vehicles and hardened on their surfaces.

The building was described as a lower-income structure with imperfect construction. Mr. Larkin showed a photograph of the wall between the units, including an area where a previous tenant had attempted to seal leaks. He argued that the separation was not properly sealed and that this allowed the overspray to reach his vehicles.

A Technical Explanation of Overspray

Mr. Larkin called Micheal Warner from Fargo Morehead Custom Collision. Warner testified that he had operated his own body shop and had approximately 35 to 40 years of experience in paint work.

Warner explained that overspray is created when air pressure in a spray gun turns liquid into a fine mist. Because the particles are so small, the mist can enter cracks and move into adjacent rooms if ventilation and containment are inadequate. Once the material dries, it does not come off easily.

Warner said overspray can sometimes be removed by machine buffing or chemicals. The method depends on the thickness and location of the material. Chemical treatment can damage a finish, while buffing can require significant labor. He distinguished ordinary smooth paint from the rougher, more noticeable texture associated with overspray.

Mr. Larkin presented a video showing the difference. He had not yet buffed the overspray from the vehicles, although he said he hoped to do so. The testimony suggested that most of the vehicles might be treated by buffing. One motorcycle, however, had a flat matte-black finish that could not be safely treated in the same way. The estimated repainting cost for that motorcycle was approximately $2,000, with additional work required to take it apart.

The Timeline That Became Decisive

James Nelson acknowledged that he had used his unit for approximately 14 years. He said he had sprayed cabinets with clear lacquer in the past and had also worked with black paint, gray primer, and white paint. He disputed that he had sprayed clear lacquer during the period when Mr. Larkin’s vehicles were stored next door.

The timeline became central. Mr. Larkin’s vehicles had been in the unit from approximately late September or early October 2015 until April 2016. Mr. Nelson said he had been told that he was no longer spraying in the unit. The testimony then established that the fire department had instructed him not to spray there in May or June 2015.

That admission created a problem for Mr. Nelson. The instruction came before Mr. Larkin moved the vehicles into the neighboring unit, but it also meant that any later spraying would have violated the direction he had received. Judge Judy concluded that Mr. Nelson had continued spraying after the warning. She found that the overspray on Mr. Larkin’s vehicles was connected to that conduct.

The court rejected Mr. Larkin’s request for $5,000. The testimony did not establish that amount as the appropriate award, and the evidence included lower estimates for buffing and a separate estimate for repainting the motorcycle. Even so, the court found that Mr. Nelson was responsible for violating the fire department’s instruction and for the resulting damage supported by the evidence.

The Rulings

In the dog case, Judge Judy dismissed the claim and instructed the parties to pay their own bills. The decisive issue was that both dogs had been outside their owners’ control, with Lora Saczawa’s German Shepherd entering Cody’s property before the fight moved into the street.

In Larkin v. Nelson, Judge Judy ruled for the plaintiff but awarded $26. The amount was far below the $5,000 sought. The ruling reflected the difference between proving responsibility and proving the full amount demanded.

Together, the cases show why a sympathetic loss does not automatically produce a legal award. In the first dispute, a dog was injured, but the court found shared responsibility and insufficient grounds to make Cody pay.
